Digital Millennium Copyright Act Information

"The Digital Millennium Copyright Act provides a new subsection 512(c) of the copyright law that affords limitations on service provider liability with respect to information residing, at direction of a user, on a system or network that the service provider controls or operates, if the service provider has designated an agent for notification of claimed infringement by providing contact information to the Copyright Office and through the service providers' publicly accessible website. 17 U.S.C. 512(c)"
Contents of Copyright Infringement Notification
Digital Millennium Copyright Act, Title II, Section 512(c)
To be effective under DMCA Section 512(c)(3)(A), a notification of claimed infringement must be a written communication provided to the registered agent that includes the following:
- The copyrighted work that allegedly has been infringed. If multiple copyrighted works at a single online site are involved, please provide a list of the works on that site.
- The material that is claimed to be infringing and provide sufficient information to permit SUNYIT to locate that material.
- Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of the copyright owner or person authorized to act on behalf of the owner.
Notice and Takedown Procedure
It is expected that SUNYIT faculty, staff, and students will comply with applicable copyright laws. It is the policy of SUNYIT to process and investigate notices of alleged copyright infringement, and take appropriate actions under the Digital Millennium Copyright Act, Title 17, United States Code, Section 512. SUNYIT will follow the procedures outlined in the Digital Millennium Copyright Act with regard to appropriate notifications to the user and the complaining party, acceptance of counter notifications, and, where indicated, putback of the alleged infringing material. Refer to the United States Copyright Office for the provisions of the DMCA at http://www.loc.gov/copyright/legislation/dmca.pdf.
Repeat Offenders
Repeat copyright infringement offenders will be escalated through the appropriate judicial channels at SUNYIT.
